How the Media Has Covered the Four Rulings on the Affordable Care Act

Steve Benen takes a look at some of the media coverage of the four key rulings on the Affordable Care Act, and finds that the two rulings pronouncing the law unconstitutional received far more attention than the two upholding it.

Four federal district courts have heard challenges testing the constitutionality of the Affordable Care Act. Two judges concluded the law is legally permissible, two came to the opposite conclusion.

But it occurs to me the public has heard quite a bit more about the latter than the former. Indeed, it seems as if the media largely ignored court rulings that bolstered the arguments of health care reform proponents, while making a very big deal about rulings celebrated by conservatives.

New York Times Admits Shutting Out Single-Payer

The media analysis group Fairness and Accuracy in Reporting (FAIR) issued an action alert September 22 titled "NYT Slams Single-Payer" that described lopsided reporting in a New York Times article about "Medicare for all," a form of a single-payer health care system.

FAIR noted that the article, titled "Medicare for All? ‘Crazy,’ ‘Socialized’ and Unlikely", laid out a list of arguments against single-payer while failing to include any balancing responses from the option's supporters.

In explaining the slant, article author Katharine Seelye said she was trying to explain why Medicare-for-all was "not going anywhere." "I thought the substance of [single-payer] had been dealt with elsewhere many times," she said.

On October 13, Times public editor Clark Hoyt conceded that FAIR "had a point," and agreed that the article excluded the point of view of single-payer health care system supporters.  FAIR said it finds Seelye's defense "alarming," and points out that the Times, like the rest of the corporate-owned media, has given the issue of single-payer health care "scant attention."
ACTION:
Ask New York Times public editor Clark Hoyt to have the Times run a piece devoted to the case for single-payer healthcare - Medicare for all. The public deserves to have the full story.

Allison Kilkenny: An example of why Americans are miseducated about health care reform

A media consumed with tracking Obama’s popularity has failed to educate the American citizenry about the key elements of the debate. Ask any 30 Americans to define Obama’s plans for subsidies, mandates, insurance exchanges, or the public option, and you’re likely to hear 30 different answers. That’s because the media has been reporting on health care issues as if gossiping about the conflicting personalities crowded in any high school cafeteria.

Maria Bartiromo shows us how media has helped sandbag health care reform

Bartiromo, both with me and in this spot with Weiner, has been hammering home the same point, that the proof that a public option won’t work can be found in the fact that the public health care system in England will not pay for the colorectal cancer drug Erbitux. I guess she is trying to say that there is rationing of health care in a single-payer system — that the fact that the government will not pay for the most expensive non-generic cancer drug on the market is proof that we shouldn’t have a public option in the U.S.

It drives me crazy when people make this argument. Fuck a fancy boutique drug like Erbitux — I have a very expensive private plan and I can’t even go to a doctor, not even to ask a simple question, unless it’s an emergency. I can’t get a routine checkup, can’t find out what that weird lump in my left foot is, can’t have the pleasure of a routine proctological exam unless I want to pay cash for it, and, well, forget about getting a filling replaced or seeing a therapist to deal with my incipient nervous collapse/burgeoning mid-life crisis. Hell, forget about paying for Erbitux, if I wanted to get a colonoscopy to find out if I needed Erbitux, I wouldn’t be able to — I’d probably have to wait until I was a fully symptomatic cancer patient before I could even have that conversation on my insurer’s dime. And I’m one of the lucky ones, I actually have money to pay for care out of pocket, if I had to. No country in the world rations care more than the U.S. There are whole generations of Americans (20-40 year-olds in particular) who don’t know what it is to be able to go to a doctor for preventive care or routine checkups. Erbitux, for Christ’s sake! Give me a break.

I’ve been getting phone calls from some folks in DC with some ugly stories about how the Democrats have systematically sandbagged the progressive opposition, with the White House pulling strings and levering the funding for various nonprofit groups in order to prevent them from airing ads attacking the insurance and pharmaceutical industries. I suspect in the end this is going to be the main story of the health care reform effort, how the Democrats (and some progressive groups) sold out their constituents in exchange for financial contributions from the relevant industries. But at the same time, you can’t discount the role certain media outlets are playing in all of this. Nobody is ordering Maria Bartiromo to lobby to keep poor people from having access to the kind of excellent health care she is fortunate enough to have been given by CNBC, for being so good at flattering Wall Street pirates on air (and off, according to some folks I know at certain banks). She just does it because that’s who she is naturally. I just don’t know how these people sleep at night — it baffles me.

NPR Enables Stealth Anti-Health Care Reform Activist

Tuesday morning on NPR's "The Takeaway", they allowed a genuine "ringer" to make a flagrantly inflammatory case against health care reform. Host John Hockenberry presented a conversation with two people who were happy with their health coverage, one of whom was Lori Roman, described as "a 46-year-old non-profit executive and political conservative from Annapolis, Maryland." In fact, she is an activist against health care reform, as even a quick check on a link provided on the "Takeaway" website (although not in the audio), would have shown.

Mr. Hockenberry and "The Takeaway" failed to provide even minimal information on this person to allow the audience to understand that they were listening to an activist against health reform, not simply a person with insurance who was happy with her coverage. Instead, they allowed her to make a misleading argument that government involvement would impair the private coverage she enjoys.

Fringe leftist losers: wrong even when they're right

...Throughout the Bush years, those who said patnetly true things were continuously dismissed as fringe, conspiracy-driven leftist-losers: those who questioned whether Saddam really had WMDs; those who argued that the invasion of Iraq would lead to long-term military bases in that country; those who worried that warrantless eavesdropping and Patriot Act powers would lead to abuses; those who opposed the war in Afghanistan on the ground that it would be unwinnable, etc. etc.

Having been proven right about all of those things hasn't changed perceptions any at all. As Ambinder's comments today reflect, the paramount unchangeable Beltway Truth is that those who distrust government claims are unSerious Fringe Leftist Losers. Even when they turn out to be right, they're still that. And no matter how many times journalists like Ambinder are proven wrong in "giv[ing] the government the benefit of some doubt, even having learned lessons about giving the government that benefit," they still continue to do it and believe it is the right and responsible thing to do.

Powerful political leaders are, as Jay Rosen often puts it, the ruling priests in the journalists' church of Savviness. Trusting the politically powerful is the establishment religion and carrying forth their message is the prime function of establishment journalists (note how Newsweek's Jonathan Alter, just two months ago, argued that the "public option" was crucial but then, like so many liberal pundits eager to maintain and build close relations with the White House, got dutifully on board with the White House message, by completely and shamelessly changing course the minute the White House did). Distrusting the statements and actions of government leaders was once the central value of our political system and of basic journalism. But now, especially in the eyes of establishment journalists, it is the hallmark of the unSerious, fringe, leftist loser, no matter how many times it is proven right.

The Healthcare Option the Media Doesn’t Want to Talk About

Great article by David Swanson about how the media refuses to educate citizens about single-payer health insurance:

President Obama said last week:

“Now, the truth is that, unless you have a — what’s called a single-payer system, in which everybody is automatically covered, then you’re probably not going to reach every single individual because there’s always going to be somebody out there who thinks they’re indestructible and doesn’t want to get health care, doesn’t bother getting health care, and then, unfortunately, when they get hit by a bus, end up in the emergency room and the rest of us have to pay for it.”

Another name for “what’s called a single-payer system” would be: healthcare as a human right, not a commodity to be purchased. Many humans have this right. They just aren’t Americans.

Obama’s mention of single-payer, in passing, as something that would be better than anything else, but something that mysteriously lies out of reach, is typical of the very few mentions of single-payer healthcare in the U.S. corporate media.

One Boston Globe column by Jonathan Cohn supports single-payer. And a short op-ed, accompanied by two opposing op-eds, in the Los Angeles Times, was written by a Brit who wants to know what in the world is wrong with single-payer. He won’t find an answer in the U.S. media, which is barely even willing to explain what single-payer is.

Paul Begala: Health care outrage goes uncovered

Stupak, and the Energy and Commerce Committee chairman, Henry Waxman, D-California, did their job. Why didn't the media do its? Why were the outrages uncovered by Stupak and Waxman un-covered by most of the media?

Maybe because the Obama White House drew the spotlight away from health care. They'd diverted the media to cover Obama's proposed reforms of the financial regulatory system.
Clinton gave his health care address to the Congress on September 23, 1993. October was supposed to be "Health Care Month" in the White House, but so many other issues got in the way that he had just one public event focused on health care in the entire month -- just one.

I understand that Obama's White House team has to juggle a lot of issues; I've been there. And I'm sure the Obama financial reforms have merit. But if the president wants to pass his ambitious health care reform, he's going to have to put other, worthy, ideas on the back burner and shine the media spotlight on the plight of people like Robin Beaton.

FAIR Study: Media Blackout on Single-Payer Healthcare

Proponents of popular policy shut out of debate

Major newspaper, broadcast and cable stories mentioning healthcare reform in the week leading up to President Barack Obama's March 5 healthcare summit rarely mentioned the idea of a single-payer national health insurance program, according to a new FAIR study. And advocates of such a system--two of whom participated in yesterday's summit--were almost entirely shut out, FAIR found.

Single-payer--a model in which healthcare delivery would remain largely private, but would be paid for by a single federal health insurance fund (much like Medicare provides for seniors, and comparable to Canada's current system)--polls well with the public, who preferred it two-to-one over a privatized system in a recent survey (New York Times/CBS, 1/11-15/09). But a media consumer in the week leading up to the summit was more likely to read about single-payer from the hostile perspective of conservative columnist Charles Krauthammer than see an op-ed by a single-payer advocate in a major U.S. newspaper.

Over the past week, hundreds of stories in major newspapers and on NBC News, ABC News, CBS News, Fox News, CNN, MSNBC, NPR and PBS's NewsHour With Jim Lehrer mentioned healthcare reform, according to a search of the Nexis database (2/25/09-3/4/09). Yet all but 18 of these stories made no mention of "single-payer" (or synonyms commonly used by its proponents, such as "Medicare for all," or the proposed single-payer bill, H.R. 676), and only five included the views of advocates of single-payer--none of which appeared on television.

Of a total of 10 newspaper columns FAIR found that mentioned single-payer, Krauthammer's syndicated column critical of the concept, published in the Washington Post (2/27/09) and reprinted in four other daily newspapers, accounted for five instances. Only three columns in the study period advocated for a single-payer system (San Diego Union-Tribune, 2/26/09; Boston Globe, 3/1/09; St. Petersburg Times, 3/3/09).

The FAIR study turned up only three mentions of single-payer on the TV outlets surveyed, and two of those references were by TV guests who expressed strong disapproval of it: conservative New York Times columnist David Brooks (NewsHour, 2/27/09) and Republican congressman Darrell Issa (MSNBC's Hardball, 2/26/09).

In many newspapers, the only argument in favor of the policy has been made in letters to the editor (Oregonian, 2/28/09; USA Today, 2/26/09; Washington Post, 3/4/09; Philadelphia Inquirer, 2/27/09; Atlanta Journal Constitution, 2/26/09).

In contrast, the terminology of choice for detractors of any greater public-sector role in healthcare--such as "socialized medicine" and "government-run" healthcare--turned up seven times on TV, including once on ABC News's This Week (3/1/09) and five times on CNN. CNN senior medical correspondent Elizabeth Cohen has herself adopted this terminology in discussing healthcare reform, stating (CNN Newsroom, 2/26/09) that "if in time, Americans start to think what President Obama is proposing is some kind of government-run health system--a la Canada, a la England--he will get resistance in the same way that Hillary Clinton got resistance when she tried to do tried to do this in the '90s."

Particularly in the absence of actual coverage of single-payer, such rhetoric confuses rather than informs, blurring the differences between the Canadian model of government-administered national health insurance coupled with private healthcare delivery that single-payer proponents advocate, and healthcare systems such as Britain's, in which healthcare (and not just healthcare insurance) is administered by the government.

The views of CNN's senior medical correspondent notwithstanding, opinion polling (e.g., ABC News/Washington Post, 10/9-19/03) suggests that the public would actually favor single-payer.

Though more than 60 lawmakers have co-sponsored H.R. 676, the single-payer bill in Congress, Obama has not expressed support for single-payer; both the idea and its advocates were marginalized in yesterday's healthcare forum. But given the high level of popular support the policy enjoys, that's all the more reason media should include it in the public debate about the future of healthcare.

Health care bills suffer conspiracy of silence -- Newsday.com:

"On Jan. 28, a coalition of advocacy groups representing 15,000 doctors and more than 50,000 nurses, met at the Capitol to present a new study asserting that the Conyers' bill, called the National Health Insurance Act (HR 676), could create 2.6 million new jobs and would cost far less than the private insurance currently paid for by individuals and employers.

Only Congressional Quarterly covered it. The Kaiser Family Foundation's daily online report on health care developments at kff.org didn't mention it. Nor has Kaiser, the most comprehensive online source of health care information, made any mention of "single-payer" (the government as the payer), or the Conyers bill since it was introduced in 2003, despite widespread support for such a plan according to Kaiser's own polls. (After my insistent inquiries, Kaiser says it will publish charts next month comparing the Stark and Conyers bills.)

"AARP, another key source of health care information, briefly mentioned single-payer in the AARP Bulletin, sent to its 35 million members. But neither single-payer nor the Conyers bill have been discussed in any of its other publications or its advocacy materials at aarp.org.

"Why? Many health care writers and advocates believe it's because single-payer and the Conyers bill would bar any role for private insurance companies, which would have central roles in all the other proposals under discussion."

Earth Day

Tomorrow, April 22 is officially Earth Day. A time to celebrate and rededicate ourselves to the preservation of our environment. For ourselves and the next seven generations.

According to the Community Environmental Council, Earth Day

was conceived by Senator Gaylord Nelson after a trip he took to Santa Barbara right after that horrific oil spill off our coast in 1969. He was so outraged by what he saw that he went back to Washington and passed a bill designating April 22 as a national day to celebrate the earth. It was in the wake of this same tragedy that Community Environmental Council was born and began working on ways to clean up our natural resources. It is due to these events that Santa Barbara is considered the birthplace of the environmental movement. The first Earth Day was celebrated in 1970. CEC organized a celebration again in 1990 and has done so every year since.

About the 1969 Oil Spill

On the afternoon of January 29, 1969, an environmental nightmare began in Santa Barbara, California. A Union Oil Co. platform stationed six miles off the coast of Summerland suffered a blowout. Oil workers had drilled a well down 3500 feet below the ocean floor. Riggers began to retrieve the pipe in order to replace a drill bit when the "mud" used to maintain pressure became dangerously low. A natural gas blowout occurred. An initial attempt to cap the hole was successful but led to a tremendous buildup of pressure. The expanding mass created five breaks in an east-west fault on the ocean floor, releasing oil and gas from deep beneath the earth.

For eleven days, oil workers struggled to cap the rupture. During that time, 200,000 gallons of crude oil bubbled to the surface and was spread into a 800 square mile slick by winds and swells. Incoming tides brought the thick tar to beaches from Rincon Point to Goleta, marring 35 miles of coastline. Beaches with off-shore kelp forests were spared the worst as kelp fronds kept most of the tar from coming ashore. The slick also moved south, tarring Anacapa Island's Frenchy's Cove and beaches on Santa Cruz, Santa Rosa and San Miguel Islands.

Ecological Impact

Animals that depended on the sea were hard hit. Incoming tides brought the corpses of dead seals and dolphins. Oil had clogged the blowholes of the dolphins, causing massive lung hemorrhages. Animals that ingested the oil were poisoned. In the months that followed, gray whales migrating to their calving and breeding grounds in Baja California avoided the channel — their main route south.

The oil took its toll on the seabird population. Shorebirds like plovers, godwits and willets which feed on sand creatures fled the area. But diving birds which must get their nourishment from the waters themselves became soaked with tar.

The Santa Barbara Zoo was among three emergency bird treatment centers established during the disaster. Volunteers were recruited to pluck oiled birds from local beaches. Grebes, cormorants and other seabirds were so sick, their feathers so soaked in oil that they were not difficult to catch. Birds were bathed in Polycomplex A-11, medicated, and placed under heat lamps to stave off pneumonia. The survival rate was less than 30 percent for birds that were treated. Many more died on the beaches where they had formerly sought their livelihoods. Those who had managed to avoid the oil were threatened by the detergents used to disperse the oil slick. The chemicals robbed feathers of the natural waterproofing used to keep seabirds afloat.

All 3686 birds were estimated to have died because of contact with oil. Aerial surveys a year later found only 200 grebes in an area that had previously drawn 4000 to 7000.
